Terms & Conditions
Welcome to RCVRI. To ensure that RCVRI is able to provide a safe and comfortable environment for all members and staff, please assist us by complying with the following conditions. We advise you to only sign this Agreement if you understand and agree to abide with these conditions. The information outlined in these terms and conditions can and will be used in the event of a discrepancy.
1. INTRODUCTION
By signing the Agreement you acknowledge and agree:
- You have been given a copy of this Agreement and agree to abide by your obligations in it;
- You are medically sound to use the Studio facilities and you use the Studio facilities at your sole risk and responsibility; and
- This Agreement also relates to your authority to any Third Party Payment Provider nominated by RCVRI from time to time to direct debit your nominated bank account or credit card for any instalments or fees due under the terms of the nominated Third Party Payment Provider’s Direct Debit Request and Service Agreement provided to you. As a member, you can use our studio in line with these terms and conditions.
2. DEFINITIONS
- RCVRI, We, Us, Our: RCVRI Mercer INC Corporation 1001008023 (“RCVRI”)
- You, Your, Client, Member: You, Your, Client, Member refers to the name in which the client account and/or membership has been created, which at times may differ to the party paying for the membership, and includes the parent or guardian of the Member if the Member is under 18 years.
- Studio: Refers to any RCVRI studio your membership entitles you to visit.
- Selected RCVRI Studio, The Studio: The RCVRI Studio where you joined. Your Selected RCVRI Studio is named on your Agreement.
- Agreement: This is the Agreement between RCVRI and you, under which you will become a member of RCVRI.
- Minimum Term: The term specified in the Agreement form.
- Studio Rules: Studio rules for using equipment, opening hours and behaviour in the Studio, specified in these terms and conditions, and in Studio signs and handouts.
- Third Party Payment Provider: “Third Party Payment Provider” means the third party payment provider nominated by RCVRI from time to time.
- Website: “Website” means the RCVRI Website at rcvri.co or such other website as notified to Members from time to time.
- Corporate Partners: A company who holds a partnership agreement with RCVRI and agrees to subsidise a portion of the full membership fees for its employees/members.
- PRODUCT TERMS
3.1 Introductory Offer
Our Introductory Offer is available to new clients only. The offer will activate from your first visit, and is valid for two (2) weeks from your first booking.
3.2 Casual Passes
Casual session passes are valid for one (1) month from the date of purchase. These are single sessions only. Casual passes totalling 60 minutes and 90 minutes must be used as consecutive 30 minute sessions within the same day. We do not provide any refunds, transfers, extensions or suspensions and all cancellations and no-shows will be considered a forfeited session.
3.3 Packages
We do not provide any refunds, transfers, extensions or suspensions on packages. Late cancellations and no-shows will be considered a forfeited session.
- A Casual 5 Pack expires three (3) months from the date of purchase.
- A Casual 10 Pack expires six (6) months from the date of purchase.
- A Casual 25 Pack expires twelve (12) months from the date of purchase.
- A Casual 50 Pack expires twelve (12) months from the date of purchase.
3.4 Gift Cards
Gift Cards may be purchased online, over the phone or in a RCVRI Studio. Gift Cards are non-refundable, non-transferrable and not redeemable for cash. Gift Cards are valid for 3 years from the date of purchase and must be used exclusively for RCVRI services. A Gift Card must be used at the RCVRI Studio from which it was purchased. Gift Cards cannot be transferred between RCVRI Studios.
3.5 AutoPay Memberships
There is no minimum contract term for automatic payment memberships. Please refer to the Suspension Policy, Cancellation Policy and Membership Transfer Policy in this Agreement for additional terms and conditions.
- REFUND POLICY
RCVRI does not offer refunds, exchanges, transfers or extensions on any product or service, for change of mind, injury, illness, change of address or any other reason. In the event that an error is made by RCVRI staff, resulting in an overpayment, an account credit will be processed. Any refund requests will be reviewed and approved at management discretion.
- PRICING POLICY
All prices are quoted in Canadian Dollars ($CAD) and all transactions are processed in Canadian Dollars ($CAD). Prices, products and offers include HST. Pricing of services may change at any time. Discounts are only available during promotional periods, which will be detailed at the time of sale. Prices may increase from time to time to reflect increases in cost and benefits.
6. BOOKING POLICY
Bookings can be made via the RCVRI app, phone, SMS, email or via rcvri.co. A confirmation email and SMS appointment reminder will be sent within 48 hours of the scheduled appointment. We require full payment at the time of your booking, either via our RCVRI app or in person at reception.
6.1 Rescheduling a Booking
- You can reschedule a booking via the RCVRI app, phone or emailing [email protected]
- If you’re more than 10 minutes late for your booking, you may not have time to complete the session, and it may need to be rescheduled to the next available appointment time.
6.2 Cancelling a Booking
- You can cancel a booking via the RCVRI app, phone or emailing [email protected]
- If you need to cancel a booking, please ensure you reschedule at least four (9) hours prior to the appointment time to avoid the session being forfeited.
- No-shows will be considered a forfeited session.
- MEMBERSHIP SUSPENSION POLICY
An automatic direct debit membership can be suspended for a minimum period of two (2) weeks, up to a cumulative maximum of twelve (12) weeks per calendar year at no cost. Suspensions must be lodged via email to [email protected] seven (7) days prior to suspension dates. Before suspending your membership, you must make sure your fees are up to date and there are no arrears outstanding on your account. Please note that we cannot backdate any suspension requests and we cannot place an open ended suspension.
- MEMBERSHIP CANCELLATION POLICY
A 7 day notice period is required to terminate an automatic direct debit membership. Notice of termination must be provided in writing and submitted via email to your RCVRI studio email address. Any outstanding payments due must be paid before the termination can be processed.
The contract will be set to terminate on the date of the next payment due, if the next payment due falls before the 7 day period.
You acknowledge that unless you provide written notice of termination, your membership fees will continue to be deducted until you provide 7 days’ written notice of your intent to terminate your membership. You shall not consider that your Agreement has been terminated until such time as this is confirmed in writing to you by RCVRI.
8.1 Permanent Sickness or Physical Incapacity
You may terminate your Agreement immediately if you are sick or incapacitated and an account suspension is not a suitable option for your circumstances. You must email a current certificate from a qualified medical practitioner to your RCVRI studio email address, stating that you cannot utilise our services foreseeably because of your permanent illness of physical incapacity.
8.2 Bankruptcy
You may terminate your Agreement immediately if you have declared personal bankruptcy and account suspension is not a suitable option given your financial circumstances. To terminate your Agreement for this reason, you must email your RCVRI studio email address with evidence of a Bankruptcy Filing or Certificate of Assignment in Bankruptcy as issued by the Office of the Superintendent of Bankruptcy Canada.
8.3 Termination by the Studio
The Studio reserves the right to terminate this Agreement in any of the following circumstances:
- You fail to abide by any of the criteria listed in the conditions of entry (posted in your Selected RCVRI Studio) after being notified of any failure;
- You fail to abide by the obligations listed in this Agreement and the breach/non-compliance is incapable of remedy or you fail to remedy the breach/ non-compliance within 14 days of being notified by RCVRI or you continue to breach this Agreement;
- If we reasonably believe that you have engaged in conduct that infringes on the health, safety or wellbeing of any other members or staff;
- The temporary or permanent closure of your Selected RCVRI Studio where a suitable replacement Studio is not available for the membership to transfer; or
- To protect the health and safety of you or other members.
- MEMBERSHIP TRANSFER POLICY
Any sessions purchased cannot be transferred to another Member’s account.
RCVRI Studios are not reciprocal and Memberships cannot be transferred between RCVRI Studios.
10. OVERDUE PAYMENTS
If there are repeated failures to meet your payment obligations (other than through the fault of RCVRI or its payment provider), without prejudicing RCVRI’s rights to recover any overdue payments, your membership may be suspended or terminated by written notice to you. All entitlements and entry into any Studio may be revoked if your account is in arrears and you fail to resolve the debt after being provided reasonable notice.
If your automatic direct debit fails to process successfully on a scheduled date, the following process will apply:
- Our system will attempt to process the payment four (4) days in a row following the failed attempt.
- The Studio will attempt to contact you about updating your payment details and re-running the debit.
- If unpaid fees remain outstanding after multiple attempts have been made by RCVRI to rectify the arrears, your membership will be terminated by written notice to you.
11. CORPORATE PARTNERSHIPS
You may be eligible to join on a membership that is discounted as a result of an agreement with a Corporate Partner. If RCVRI’s agreement with that Corporate Partner and/or your employment/membership with the Corporate Partner ceases, we may, at our discretion, revert your membership to the agreed full standard rate for the remainder of the membership term. If this occurs as a result of RCVRI’s agreement with that Corporate Partner ceasing, then we will provide you with notice as soon as practical by mail or email (at our choice) using the most up to date physical or email address that you have provided us.
12. STUDIO ACCESS
- All members must check in at reception upon entry to their Selected RCVRI Studio at every visit.
- Upon joining RCVRI, a photo will be taken of you for safety and security reasons and the photograph will be used and stored in accordance with our Privacy Policy.
- All guests and visitors to RCVRI Studios are required to check in at reception upon every visit, complete the liability waiver, and otherwise comply with our general conditions of entry and Studio Rules as contained in these terms and conditions.
13. CONDITIONS OF ENTRY & STUDIO RULES
To assist us in maintaining a safe and comfortable environment for all members and staff, you are required to abide by the following conditions. Failure to abide by these conditions may result in the suspension or termination of your membership.
General Rules
- Age Requirement. You must be 16 years or over to use the facility. Anyone under 18 years of age will need permission from a parent or guardian.
- Children. For the safety and comfort of our staff and clients, we ask that no children accompany you to your appointment.
- Arrival. You are required to arrive on time, as lost time may be forfeited. Please arrive 5 minutes before your scheduled session time. This ensures you have time to change and make the most of your RCVRI experience.
- Entry. Entry will be refused or you may be requested to leave the Studio if you are using abusive or threatening language or behaving in a threatening way; or are under the influence of drugs or alcohol; or you behave in another way that is considered by RCVRI to be risky or seriously inappropriate.
- Behaviour. You should conduct yourself in a manner that will not disturb or impair the use and enjoyment of that Studio by any other person. In particular you may not use foul, loud or abusive language, nor will you behave in a threatening manner, nor will you molest, or harass, other Members, guests, visitors or staff.
- Camera Use. Taking photos or videos of other members without their consent is a breach of our terms and conditions. You may be requested to delete them if anyone challenges whether or not they feature. If we have concerns with you taking photo or video footage in the Studio, we may ask you to show us the images taken and ask you to delete them if appropriate.
- Non-Smoking. Smoking is strictly prohibited in the Studio, including the use of electronic cigarettes or similar devices.
- Drugs and Alcohol. You may not bring, use, or be under the influence of drugs or intoxicating liquor or substances in any part of the Studio.
- Food and Water. We recommend having something to eat before your session, especially in the early mornings. We also recommend drinking plenty of water before, during and after your session.
- Clothing. All members and guests must be dressed in suitable attire at all times while in the Studio. Appropriate swim attire must be worn in the saunas and pools. For dry services, we recommend wearing loose, comfortable clothing or exercise attire.
- Footwear. We recommend wearing pool slides in all wet areas to avoid slipping.
- Showering. You are required to shower before and after your session if using the saunas and/or pools. Avoid the use of body creams, oils and fake tan in all service areas.
- Towel Use. You are required to use our provided clean towels for your session, dry off before entering the saunas and sit on a towel while using the saunas. We ask that you use a towel when moving between wet area services. Towels are available from reception and must be returned to reception upon exit.
- Lockers. All personal belongings are required to be stored in the lockers provided. RCVRI does not undertake that use of a locker will guarantee that no theft of or damage to your property will occur. We will not accept any liability in relation to locker thefts. Locker keys must be returned to reception upon exiting the studio and must not be taken from the studio at any time.
- Lost Property. Found items will be stored at reception for four (4) weeks and then donated to charity.
- Complaints. Complaints should be communicated privately to a member of the relevant Studio’s management in person or via email.
Health and Safety Rules
- You must use the main entrance to a Studio when entering or leaving that Studio.
- You must not interfere with or obstruct fire doors for any reason.
- You must read the health and safety notices posted outside any equipment or facility rooms in a Studio and comply with the recommendations.
- You must comply with any reasonable requests made by staff in relation to matters of health and safety.
- You must: (a) not run around the wet area or jump into the pools; (b) comply with any signs in the wet area; (c) wear appropriate swimwear.
- No balls, floats or inflatables are permitted in the pools other than those provided by the studio.
- You may not use the saunas or pools while under the influence of alcohol, anticoagulants, antihistamines, beta-blockers, narcotics or tranquillisers.
- For reasons of health, safety and hygiene you must:
(a) not consume, store or bring into the changing rooms or pool area, any food or drink or any kind of glass container;
(b) only shave in the wash basins provided;
(c) not attempt to dry clothes or towels in the saunas;
(d) not bring sauna oils or essences, cosmetic products, newspapers/magazines/books or other flammable materials into the saunas, as these constitute a serious fire hazard;
(e) not bring oils or essences into the saunas, as pouring them on the steam outlet will create a burn hazard.
All RCVRI members, guests, and visitors must comply with these Studio Rules, which are incorporated into a Member’s Contract with us. Compliance with the Studio Rules is important to maintain the standards at our Studios and to enable Members to get full enjoyment from their Membership.
Any person who does not comply with the Studio Rules (or engages in any other misconduct) may be ejected from, or denied access to a Studio, or may have their Membership terminated by RCVRI.
We reserve the right to make reasonable amendments to the Studio Rules at any time. If we do this, we will give Members reasonable notice by making you aware in Studio. As such, the Studio Rules will change from time to time.
14. LOCKERS, VALUABLES & LOST PROPERTY
- Lockers are available and are located in the change rooms, however lockers are NOT security devices.
- To the extent permitted by law, Studio employees or contractors are not responsible for any loss of, or damage to, personal property from the Studio or a locker.
- The Studio is unable to look after your personal possessions (keys and wallets for example) whilst you are in the Studio.
- Bags and other personal belongings are not permitted on the Studio floor for safety reasons.
- Personal items are not permitted to be stored in lockers overnight. Any items remaining in lockers or items that have been handed into Reception will be held for four (4) weeks and then donated to charity.
15. CCTV
- The Studio is monitored by Closed Circuit Television (CCTV) at all times.
- You acknowledge and understand that CCTV will be installed in appropriate areas within each Studio and surrounds as a strategic component for team member, member and contractor safety and crime and misconduct prevention.
- By entering our Studio, you consent to being filmed under CCTV for these purposes and understand that we will only use and store your image in accordance with our Privacy Policy.
16. PRIVACY POLICY
Your “personal information” (as defined under the Personal Information Protection and Electronic Documents Act (PIPEDA)) will only be used in accordance with our Privacy Policy.
RCVRI will use the contact details you have provided to communicate with you about your membership. RCVRI, its related companies, and service providers engaged on our behalf may also contact you during and after your membership with information about wellness, promotions, special offers, and other materials related to RCVRI’s services and products.
RCVRI will not share your personal information or contact details with unrelated third parties.
Depending on your communication preferences, we may contact you via mobile, email, and/or SMS. You may opt out of receiving marketing communications at any time by contacting us at [email protected].
- LEGAL RESPONSIBILITY
17.1 Meeting Your Responsibilities
- Your responsibilities, including payment of membership fees, do not depend on how often you use a Studio.
- You must tell us about anything that affects your membership, and any changes to your contact information and bank details.
- If you have any medical concerns, allergies or injuries, you must consult your Doctor or General Practitioner, before using any of our services.
- You must inform us in advance and in writing if there are any risks to your health if you participate in any of our services and provide us with written medical clearance from your Doctor or General Practitioner.
17.2 Promising to Take Care
You promise to:
- Make sure that you know how to utilise our services safely, by asking if necessary;
- Use your best endeavours to use our services safely; and
- Not take valuables into the Studio, even if you plan to put them in a locker.
17.3 Damage & Personal Injury
To the extent permitted by law, RCVRI excludes any liability to the member in Agreement, tort, statute or in any other way for any injury, damage or loss of any kind whatsoever (including, without limitation, any liability for direct, indirect, special or consequential loss or damage), sustained by the member and/or any other person, or for any costs, charges or expenses incurred by the member, arising from or in connection with this Agreement and/or the services/products provided by RCVRI and/or any act or omission of RCVRI.
17.4 Outside Providers
Contractors, tenants and franchisees provide some services in our Studios, such as physiotherapy (Outside Provider). You will need to pay service fees directly to the Outside Providers and we are not responsible for those fees or for any associated costs or refunds.
Claiming against Outside Providers
- Any service provided by an Outside Provider is a contract between the Outside Provider and you and we to the extent permissible by law, we do not accept any responsibility for a breach of contract or negligence.
- If you make a claim because of something an Outside Provider has or has not done, your claim should be brought against the Outside Provider, not us, whether you have paid them or not. To the extent permissible by law you release us from any claim resulting from an act or omission by an Outside Provider.
18. STAYING UP TO DATE WITH OUR TERMS
We may sometimes change our terms and conditions. This includes changing a Studio’s opening hours, its services and facilities and membership fees. Sometimes, we may also close Studios for refurbishment. We do not reduce your membership fees because your Studio is closed for renovations or repairs (where a suitable substitute Studio is available) or for a public holiday. The most up-to-date terms and conditions always apply. You can find copies at your local Studio or on our website rcvri.co.
19. ENTIRE AGREEMENT
This Agreement and any Special Terms & Conditions listed on the website constitute the entire agreement, understanding and arrangement (express and implied) between the Member and RCVRI relating to the subject matter of this Agreement and supersedes and cancels any previous agreement, understanding and arrangement relating thereto whether written or oral.
